General Background Information
The use of pesticides in North Dakota is based upon federal law--the Federal Insecticide Fungicide and Rodenticide Act or FIFRA, and state law--the North Dakota Pesticide Act. The federal government through the U.S. EPA delegates authority to implement these laws to the states.
In North Dakota, the Department of Agriculture (NDDA) is charged with enforcement responsibilities while general policy decisions are left up to the North Dakota Pesticide Control Board. Finally, pesticide applicators and dealers may also be subject to regulation through the: North Dakota Century Codes and Administrative Rules Which Involve the Use and or Sale of Pesticides
